Charles A. ("Al") Hammaker, III

Highly Qualified.    Al Hammaker, Senior Counsel at Ballard & Littlefield, LLP, is a seasoned litigator with over 27 years of experience handling trials and arbitrations of commercial disputes.  In addition to his comprehensive knowledge of commercial litigation and employment matters, Mr. Hammaker has substantial experience in securities-industry arbitration, litigation, regulatory matters and appeals.

Drawing on the breadth and depth of his experience, Mr. Hammaker can quickly identify issues and pursue the most advantageous, cost-effective course of action in a case.   Throughout his career, Mr. Hammaker has demonstrated an ability to obtain successful results in the matters he handles, as indicated by the following reported cases:

  • In Gilchrist v. Carroll, 2011 Tex. App. LEXIS 9427, 2011 WL 5999012 (Tex. App.—Houston [14th Dist.], 2011), the Plaintiff, Carroll, had sued Gilchrist for failure to deliver stock certificates and to pay certain debts.  After a three-week trial, Mr. Hammaker obtained a favorable judgment exceeding $1.5 million including $251,014 in attorney’s fees.  Mr. Hammaker further successfully defended the appeal.
  • In Formosa Plastics Corp. v. Hunt, 1999 LEXIS 1166, 1999 WL 33907483, (Tex. App.-Corpus Christi, 1999), Mr. Hammaker was instrumental in obtaining an appellate court reversal of a jury award of $1,527,581.37 against Formosa Plastics Corp. (“FPC”).  The appeals court also rendered a decision, holding that although FPC had contracted with Plaintiff’s employer to assist in the construction of the plant where Plaintiff worked, there was no evidence that FPC had created the condition which caused the injury.
  • In Pepe Internat'l Dev. Co. v. The Pub Brewing Co., 915 S.W.2d 925 (Tex. App.-Houston [1st. Dist.] 1996, Mr. Hammaker was successful in reversing the lower court's order denying the motion of Pepe International to compel arbitration.  This interlocutory appeal and mandamus action resulted in an order compelling Plaintiff to arbitrate its claims against Pepe International.     
  • In Sipco Servs. Marine, Inc. v. Wyatt Field Serv. Co., 857 S.W.2d 602 (Tex. App. Houston [1st Dist. 1993], Mr. Hammaker successfully represented Wyatt Field Service Company in its effort to recover the difference in the amount of a bid that Sipco Services Marine, Inc. had submitted, then later withdrew, and the higher amount Wyatt had to pay to another contractor to complete a project.  He obtained a verdict for the full amount of damages plus attorney's fees, and successfully defended that award on appeal.

Highly Regarded. Before joining Ballard & Littlefield, LLP as Senior Counsel in 2004, Mr. Hammaker was a partner at Gardere Wynne Sewell LLP, one of Texas’ largest law firms, where Mr. Hammaker practiced trial and appellate litigation in both federal and state courts.  His experience included matters concerning commercial litigation, personal injury defense, products liability litigation, collection matters, construction litigation, toxic tort and environmental litigation, probate litigation, property disputes, and antitrust litigation.

Mr. Hammaker is a 1986 graduate of the University of Houston Law Center, and he obtained his undergraduate degree in 1979 from the College of William & Mary in Virginia.  Mr. Hammaker served as an officer in the United States Army from 1979 to 1983, during which time he completed the intense and rigorous combat leadership course at the Army’s Ranger School and achieved the rank of Captain.   

Mr. Hammaker’s bar admissions include the State of Texas, the U.S. District Courts for the Northern, Southern and Western Districts of Texas, the U.S. District Court Western District of Arkansas, the U.S. District Court District of Arizona, and the U.S. Court of Appeals 5th Circuit.  Mr. Hammaker has been a member of the State Bar of Texas since 1987, and is a member of the Texas Bar Foundation.  He was on the Board of Directors and Chairman of the Finance Committee of the Japan-America Society of Houston for several years.  Mr. Hammaker has the highest rating of "AV" from Martindale Hubbell, the national directory of attorneys, indicating preeminent legal ability and the highest standard of ethics.
